The core of Gertjan Kuipers' practice is patent law, where his background in science serves him well. His practice cuts across all fields of technology, including electrical, mechanical, computer technology, pharmaceutical and chemical.
Gertjan advises and litigates for a number of national and international companies. Most of Gertjan’s work is cross-border in nature and he has ample experience in conducting and coordinating multi-jurisdictional litigation.
Gertjan was lead counsel in the widely reported Senseo coffee pad cases dealing with the concept of indirect patent infringement in which he worked with and coordinated the work of IP firms in four European countries (Sara Lee/DE v Coffee pad producers). Gertjan is and has also been involved in a number of cases relating to standards in the electronics and telecommunications industry, which required close cooperation with Competition law departments.
Recent cases of note include a case in which Gertjan obtained for his client the highest damages ever awarded by a Dutch court in patent infringement proceedings (Bom v Alcoa) . For the Dutch arm of the international litigation for a large windturbine producer, Gertjan managed to fence off the threat of an injunction by getting the patents invalidated. On the advisory side, he is often involved in IP matters in deals from De Brauw M&A and Finance departments, including recent transactions involving NXP.
Gertjan lectures on patent law at universities and to IP practitioners-in-training and is a contributor to the patent section of the Elsevier loose-leaf commentary on IP.
He is an alumnus of the Fulbright Program.
