In March 2021, the European Parliament asked the Commission to urgently initiate binding legislation ensuring companies are held accountable when they harm human rights, the environment and good governance. Not only individually and directly, but throughout their value chain as well. And the proposal had to include explicit access to legal remedies for victims. In its reaction, the Commission promised to deliver a proposal later this year.

 

Human Rights and ESG-related law suits are pending in several jurisdictions across the world. The relevance of the claims is not just legal or monetary – there are also significant societal and reputational aspects to consider. So how to operate in this changing landscape?
