Master Class – First aid for non-performance

What to do if a counterparty does not fulfil its obligations under a contract? How do you act – if you, as a party, are in danger of being unable to comply?

These questions remain topical and very relevant in daily contract practice. Daan Beenders and Tilly Alberga-Smits discuss many subjects – such as non-fulfilment, notice of default, default, compensation and the obligation to complain – from a legal perspective, but above all, they discuss them from a practical perspective.

Among the questions answered is how a file can best be built up in case of (potential) default of the counterparty, and which actions can then be set. In this masterclass, we will also discuss how the rights of a party faced with a (threatening) non-compliance can best be safeguarded. And, of course, in the discussion of these matters, current developments in jurisprudence, among other things, will be considered.
