Master Class – Tax efficient IP structures

Tax efficient IP structures of multinationals have become the subject of intense scrutiny from Brussels and the OECD. In the form of a steady flow of EU State aid investigations and legislative initiatives that fundamentally move the goalposts for the taxation of these structures.

Tobias Cohen Jehoram, Arjan Kleinhout & Wiebe Dijkstra will discuss these challenges and share views on how risk may be managed, both in relation to the past and going forward. Particular points of focus will include (i) the interaction between the legal aspects of IP structures and their tax treatment, and (ii) the procedural aspects of State aid cases (including exposure) and how to handle these. They will also address various avenues which optimise the chances of making IP structures both “Brussels- and OECD-proof”. The approach will be practical and interactive.
