Virtual Master Class – Recent Dutch, EU and other international tax developments

During this Master Class, Paul Sleurink, Frank Pötgens and Ingrid Mensing will discuss the Emergency conditional exit tax dividend withholding tax act (Spoedwet conditionele eindafrekening dividendbelasting) introduced by GroenLinks member of parliament, Bart Snels. They will focus on the impact this new levy may have on M&A transactions and internal restructurings, and its compatibility with EU law and Dutch tax treaties. They will also be discussing the Dutch Supreme Court’s ruling in the DEKA case, where it outlined  the conditions under which foreign investment funds are eligible to claim a Dutch dividend withholding tax refund. The decision will have a profound impact on the thousands of pending claims for refunds, and will likely give rise to new controversies.
