Master Class - ESG initiatives and competition: ACM and EU legislative developments

During this Master Class, Helen Gornall looks at the evolving sustainability agreement landscape and analyse the opportunities for competitors to cooperate in this area. We examine the overlapping and, at times differing, regulatory approaches of the European Commission and the Dutch competition authority (ACM). In the Netherlands, a steady trickle of approved sustainability cooperations is already demonstrating that companies can pursue green ambitions together without falling foul of competition law.

With the help of Nicole Rosenboom, an economist at Oxera Consulting and environmental economics expert, we will discuss some of these ACM-backed agreements and how regulatory compliance has been achieved. From packaging reduction initiatives to carbon capture and storage, cooperation with competitors may be acceptable if these projects are structured within the appropriate competition law and economic frameworks. Our Master Class will also highlight how greenwashing by businesses in their product or service sustainability claims remains firmly on the radar of consumer law enforcement authorities.
