Master Class - Privilege issues in practice

Legal privilege is the cornerstone of the legal system, protecting communication between clients and in-house or external counsel. But as fundamental as it may be, in a world of ever increasing demands for transparency, it is under pressure. In today's climate, business partners, regulators, prosecutors and public interest groups alike are testing the boundaries of companies' reliance on legal privilege. The call by these entities to disclose documents often leads to privilege being increasingly challenged.

This can have a profound impact on communication with in-house and external counsel. Companies relying on legal privilege are well-advised to be mindful of its limits and to implement strategies to safeguard it.

In this Master Class, Eelco Meerdink and Martje Verhoeven - de Vries Lentsch will navigate the limits of legal privilege and develop practical strategies to safeguard it. Based on recent case law and practice, they will formulate key takeaways to protect legal privilege in a challenging and changing environment.

Eelco meerdinka

Martje verhoevenb
Martje is widely known for her expertise in commercial arbitration and complex cross-border litigation, notably in the field of energy and technology, where she advises clients on critical strategic matters and has represented these companies in a range of arbitrations and court cases. Martje has over 10 years of experience in the oil and gas industry. This includes in-house experience gathered during a secondment to Shell's litigation department in Houston and her role as litigator at the Houston office of Haynes & Boone. Clients value Martje as an accomplished practitioner who can advise on both legal and economic issues in highly complex disputes. Martje's expertise also includes disputes related to joint ventures and collaboration agreements and issues related to recognition and enforcement of foreign judgments and annulment of arbitral awards, and related attachment proceedings.
