Tackling climate change is one of society's key challenges, and growing public awareness has triggered a rapid increase in litigation on climate change issues. Around the globe, states and private parties are facing a range of actions, from climate change-related damages claims to applications for injunctions aimed at reducing CO2 emissions. The latest regulatory and policy initiatives in the EU (Fit for 55) and at the global level (COP26) will undoubtedly impact many corporates in different ways. And spark even further debate on corporate responsibility and accountability in the environmentalcontext.

In this Master Class, Nicolien van den Biggelaar, Dennis Horeman & René van Tricht consider recent trends in climate change litigation. They will discuss actions brought against states and private parties in the Netherlands and around the world. Based on this, Nicolien, Dennis and René provide practical guidance on how companies can manage these intensifying climate change and other ESG-related developments.

Nicolien van den Biggelaar is an experienced litigator and expert in public law, including Dutch and European environmental law and spatial planning, and regulatory and enforcement matters. Her main focus is on the energy sector, including energy transition and climate change, and on state-owned companies responsible for vital networks and infrastructure. Nicolien regularly represents clients in negotiations with regulatory authorities and in litigation before administrative and civil courts. She communicates easily with stakeholders and regulatory authorities alike, and actively works with environmental and technical specialists to build strong cases which withstand judicial review proceedings by third parties. Her expertise is regularly sought in M&A transactions. Nicolien is ranked first tier in Chambers Europe. Legal 500 EMEA consistently recognises her as a leading environmental lawyer and she was inducted into the Legal 500 Hall of Fame – Environment and Planning. In 2019 Nicolien was awarded the Euromoney European Women in Business Law Awards 'Best in Environment'.
Dennis is a member of the dispute resolution practice and the financial markets regulation practice. He has wide experience in litigation and arbitration in the financial sector. He represents banks and insurers in a wide range of disputes, including the defence against claims for alleged duty of care and misselling. He also represents financial institutions as claimant against other parties. Dennis leads the defence in a wide range of collective litigation matters from financial services, to consumer products, and climate change. He represented Ageas in the most recent court-approved collective settlement in the Netherlands. Dennis is an expert on insurance law. He acts for corporate insureds in complex claims involving product liability, professional liability, D&O liability and fraud.
