Credit crunch measures: De Brauw advises the Dutch State, Fortis, ING and SNS REAAL

The Dutch authorities have recently taken a variety of measures designed to restore confidence and to stabilise the financial markets, beginning with the EUR 16.8 billion nationalisation of Fortis.

De Brauw designed many of these measures and was involved in all of them, either advising the Dutch State or major financial institutions, including the establishment of a EUR 200 billion interbank lending guarantee and the EUR 20 billion emergency funding plan for Dutch financial institutions. De Brauw has also advised the State on the EUR 3 billion recapitalisation of insurance group AEGON and on the arrangement with the Republic of Iceland relating to Landsbanki.

Furthermore, De Brauw acted as counsel to private parties, including:

  • Fortis on the EUR 16.8 billion nationalisation by the State
  • SNS REAAL on the requested EUR 750 million emergency funding from the State
  • ING Group on the requested EUR 10 billion emergency funding from the State
