No help for bankruptcy trustee when challenging security for new credit relationships

The Dutch Supreme Court recently ruled in a fraudulent preference case that where security has been provided for a new credit relationship, there is no evidentiary presumption that the parties involved had knowledge of preference.This makes it harder for the trustee to nullify a secured credit facility under Dutch fraudulent preference rules (this article is available in Dutch only).
