Bommel van der Bend’s practice consists mainly of handling complex arbitrations and advising on contractual issues in the area of large-scale construction projects and commercial contracts in the oil, gas and electricity industries. Bommel´s clients include a multinational oil company, a multinational electricity production and distribution company, the Dutch rail infra provider, a multinational engineering company, a major seaport and a worldwide operating deep-sea drilling company.
Bommel acts on a regular basis as counsel in both international and national arbitrations under the rules of UNCITRAL, ICC, Netherlands Arbitration Institute (NAI) and Dutch Arbitration Court for Construction Matters.
Recent work includes:
- acting as lead counsel in a multi billion euro UNCITRAL arbitration in regard of the price review mechanism in a long-term gas export contract
- acting as counsel in a series of proceedings to set aside an arbitral award in regard of a number of ICC awards that were rendered in a multi million euro dispute on the upgrade of a world wide fibre glass cable system
- advising on a dispute between the European and Russian shareholders of a worldwide joint venture
- advising on contract strategy for a major land reclamation project aimed at the realisation of sea harbour facilities.
Bommel is vice-president of the governing board of the Netherlands Arbitration Institute In addition he is a member of the tender board "Tweede Maasvlakte", an independent advisory board that advises Port of Rotterdam on issues regarding procurement and contract strategy for a major land reclamation project aimed at the realisation of sea harbour facilities. Bommel is co-author of the leading handbook on European and Dutch procurement law.
