Tobias Cohen Jehoram specialises in intellectual property, and in particular trademark and design law. His practice extends to copyright, advertising and media law. He specialises in quick and effective remedies for national and international IP infringements, and also frequently assists in mergers and acquisitions.
Tobias' clients are typically multinational corporations and foreign law firms seeking assistance in IP issues in the Netherlands or the Benelux. Most of his cases have cross-border aspects and he is regularly instructed by his clients to coordinate international cases. In addition, Tobias is a Supreme Court litigator. He has been involved in most of the landmark IP cases decided by the Netherlands Supreme Court in the past five years.
Recent work includes advising and litigating for the world's two largest producers of fast-moving consumer goods (food and non-food), a major player in the soft drinks market, one of the world's largest chemical companies, several fashion brands, a well-known chip manufacturer, the largest Dutch telecom operator, music publishers and organisations representing the music industry. Recent landmark cases include the protection of copyright protection for smells (perfumes) and on testimony, liability of auction sites and the trademark protection of sounds. He also assisted in the recent acquisition of a major Dutch developer and producer of irrigation materials.
Tobias is a professor of Intellectual Property Law at Erasmus University Rotterdam. He publishes, mostly on trademark law issues, database protection and TRIPS (author of the Schuurman & Jordens part in TRIPS). He is the primary author of the leading handbook on Benelux and Community Trademark Law, which was published fall 2008. Also, he lectures both for professional educational organisations, such as Grotius, and universities. Tobias is a member of INTA, Marques, AIPPI, LES, BMM, ALAI and VvA. He is a WIPO arbitrator under the ICANN rules and arbitrator in .nl domain name disputes.
