Vivien Rörsch specialises in intellectual property, in particular copyright law. Her practice extends to entertainment, media, copyright and trademark law, database and know-how protection.

She litigates before European and Dutch courts and represents media and entertainment businesses and various copyright and neighbouring rights societies.

Vivien is a Supreme Court litigator and has been involved in most of the landmark IP cases decided by the Netherlands Supreme Court in the past five years, such as copyright protection for smells (perfumes) and the ground-breaking decision on whether US performing artists are entitled to the “private copying levy”. Recent work includes representing and advising intellectual property societies fighting online copyright infringement and litigation before the European Court of Justice concerning the concepts of ‘fair compensation’ and the ‘three-step-test’ in the Infosoc Copyright Directive.
