Davine is an all-round litigator with an extensive track record in complex disputes, often with a technical or international angle. She was seconded to London magic circle firm Slaughter &amp; May in 2018. She has over a decade of experience in advising clients and litigating on their behalf before Dutch courts and arbitral tribunals (ICC, NAI, LCIA, UNCITRAL, etc.). Davine handles commercial and corporate matters that are crucial to our clients, often relating to the financial sector, large transactions, or governance and stakeholder issues. Davine is also highly experienced in dealing with execution and enforcement proceedings, attachments and injunctions, litigation funding issues, and various types of discovery processes. In this work, Davine often works together with firms in other jurisdictions, such as the UK and US on our clients' global defence.
In addition, Davine heads De Brauw's Climate and Sustainability Group, which is a cross-expertise working group of lawyers from several practice areas. Davine is highly knowledgeable on ESG-regulation, such as the CSRD and CSDDD. In this context, Davine has specific expertise in climate transition planning from a mitigation and adaptation perspective and climate scenario application. She holds a UNEP FI Climate Risk certificate, regularly speaks and publishes on the topic of climate risk management, mitigation and adaptation, and contributes to the Oxford University Net Zero Regulation and Policy Hub and its Climate Monitor. Davine regularly advises our clients on sustainability and value chain management, and on reporting and related greenwashing risks, and trains the boards of our clients on these topics.

 <li>Defending former SNS REAAL in inquiry proceedings against investors VEB and others before the Dutch Enterprise Chamber following the SNS REAAL's nationalisation in 2013, and in ancillary proceedings.</li>
 <li>Defending a foreign investor in a takeover attempt launched by a co-investor on investments in the Venezuelan oil sector.</li>
 <li>Defending Sunweb in summary proceedings and emergency appeal, regarding the takeover of Corendon.</li>
 <li>Representing SeeCubic and investors in proceedings against a former business partner relating to the ownership of assets.</li>
 <li>Defending Rabobank in class actions about interest rate swaps, and in related individual actions.</li>
 <li>Representing GasTerra in several multi-million price-revision arbitrations against buyers under long- term gas sales agreements.</li><li>Representing KMG on EUR 200 million post-M&amp;A arbitration and follow-on proceedings against the heirs of a Romanian oligarch.</li></ul>

Mariska is head of our Financial Markets Regulation practice and co-head of our Financial Institutions group. She focuses on matters of strategic importance to financial institutions in both advisory and transactional matters. Mariska has a specific focus on private equity-related matters, governance, regulatory capital, recovery and resolution. 
 
Mariska regularly advises financial institutions including banks, insurance companies and payment institutions on topics like structuring and restructuring, governance and conduct of business, as well as on dealings with the regulators. In addition, she is frequently involved in M&amp;A transactions and negotiations regarding investments and divestments, including for private equity clients.
As part of De Brauw's corporate practice, Mariska also advises regulated clients on corporate structuring and governance.
Legal 500 named Mariska a Next Generation Partner for the investment management sector in 2024.

Mariska Enzerink

Irina specialises in international investment and commercial arbitration. She has acted as counsel in arbitration proceedings under the ICC, NAI, ICSID, and PCA rules, as well as in proceedings before Dutch courts. Before joining De Brauw in 2015, Irina was a Doctoral Fellow at the Netherlands Institute for the Law of the Sea (NILOS). She has also worked as an Associate Legal Officer at the International Court of Justice in The Hague, and as part of the arbitration practice of a major international law firm in Paris. Irina is the author of numerous articles on international law and dispute settlement, as well as of a book on international law published by Oxford University Press in 2018. Irina has received various awards, including the Clifford Chance Prize for Best Performance in the MJur Programme and Winter Williams Prize in International Economic Law at Oxford, as well as awards from the Royal Netherlands Society of International Law, the Rhodes Academy of Oceans Law and Policy, and various other organisations.
The European Union recently appointed Irina to the roster of arbitrators - alongside five other individuals - for the settlement of future disputes between the EU and the UK under the EU-UK Trade and Cooperation Agreement (TCA). Irina was also appointed to the pool of arbitrators and trade and sustainable development experts under the EU's trade agreements with third countries.
