Masterclass - Navigating and securing legal privilege in practice
Martje de Vries Lentsch and Tes Flapper will be providing practical tools and recent case law insights, while also taking a step back to reflect on the broader role of privilege within our legal system.
We will be joined this year by our colleague Professor Jonathan Soeharno, who teaches administration of justice and legal philosophy at the University of Amsterdam. Together, we will examine how privilege safeguards the role of lawyers within the justice system and how this intersects with the realities of the legal practice, including in-house.
What to expect:
- A discussion on ethical and philosophical perspectives: what legal privilege means for lawyer's independence and the rule of law.
- A refresher on the essentials of legal privilege and on how to establish and preserve this in day-to-day corporate communications.
- A recap of recent developments in Dutch and EU case law, including implications for in-house practice.
- Practical strategies and pitfalls for managing privilege – including in situations where in-house lawyers also serve in management roles such as Chief Legal Officer.
- An interactive exchange, combining real-life examples and case law analysis with participant's input.
