BUSO EVENT Banner website masterclass vs01 02

Mass claims and class actions are rapidly reshaping Europe’s litigation landscape. Offering a claimant-friendly system, strong litigation funding and efficient procedures, the Netherlands is right at the centre of this shift. Dutch courts have become the venue of choice for high-value collective actions, making the Netherlands an important venue not only for claimants but also for companies defending against these actions.

In this Masterclass, Machteld de Monchy, Johan Valk and Tim Kluwen will analyse the most significant recent trends and cases shaping collective actions, including:

  • groundbreaking case law from Dutch and European courts, including the Supreme Court of the Netherlands, the CJEU, and the ECHR;
  • the government's evaluation of the WAMCA and its implications in practice;
  • the rise of third-party litigation funding and the European Commission's decision not to regulate it; and
  • the Representative Actions Directive and its effects on cross-border claims.
