British Airways air cargo cartel damages litigation - Chinese cargo claims face challenge in court

China's Chamber of International Commerce is set to defend its right to bring a follow-on claim in the Netherlands against British Airways and KLM for alleged losses linked to the so-called air-freight cartel. During a hearing before the Amsterdam District Court, scheduled for 9 December 2015, British Airways and KLM are expected to argue that the Chinese organization has no authority to bring proceedings on behalf of its members and non-members, mirroring a similar dispute in parallel proceedings in the UK, currently pending before the High Court in London. De Brauw assists British Airways in multiple follow-on actions in the Netherlands, all relating to the so-called air-freight cartel.
