ENNIA gets big bail out - governments Curacao, St Maarten and Central Bank set up a new bailout fund

ENNIA, the largest insurance group in the Dutch Caribbean with insurance companies located in Curaçao, Sint Maarten, Aruba and Bonaire, and business in the other islands as well as Suriname, received a large bailout from the governments of Curacao, Sint Maarten and the Central Bank. ENNIA has been in severe financial difficulties due to mismanagement and fraudulent behaviour of its owner Parman International B.V., led by Iranian-American Hushang Ansary. De Brauw has successfully assisted the Central Bank of Curaçao and Sint Maarten (CBCS) in litigation proceedings against Ansary and former directors of ENNIA, which resulted in a number of positive judgements ordering Ansary and the former directors to repay ENNIA hundreds of millions of Netherlands Antillean guilders in damages. The group requires alternative funding solutions at least until those funds come in.

Supreme Court appeal over dismissal and academic freedom

Today, our firm filed an appeal with the Dutch Supreme Court on behalf of a former senior lecturer at the University of Groningen (RUG), requesting that a 8 January 2024 decision of the Arnhem-Leeuwarden Court of Appeal be set aside. The case revolves around the question of how closely courts should see to it that scientists' academic freedom and freedom of expression are safeguarded in employment termination proceedings.

TenneT issues EUR 1.1 billion hybrid bonds

De Brauw assisted TenneT on the issuance of EUR 1.1 billion hybrid bonds in a dual tranche issuance that was more than six times oversubscribed at the peak. It concerns Green Hybrid Bonds of EUR 550 million with a coupon of 4.625% and a non-call period of 5.25 years and EUR 550 million with a coupon of 4.875% and a non-call period of 8 years, respectively.

De Brauw supported TenneT in attracting a EUR 25 billion bridge loan facility from its shareholder, the Dutch State. While TenneT and the Dutch State are exploring a potential sale of TenneT's German operations to KfW, acting on behalf of the German State, the Dutch state has provided a bridge loan facility of EUR 25 billion to TenneT, safeguarding TenneT’s planned investments in the Netherlands and Germany for 2024 and 2025.
