The Netherlands has emerged as a leading forum for collective redress in Europe. The Resolution of Mass Damage in Collective Action Act (known as the WAMCA) has accelerated this development. The WAMCA allows claims for monetary damages, sets stricter admissibility requirements and introduces a special procedure. WAMCA class actions cover a wide range of areas, including data protection, consumer law, competition law and environmental law.
Although the WAMCA has now been in place for almost six years, questions about its practical application continue to arise.
